Capital One agreed to pay a $190 million settlement to customers who opted-in to the settlement by the deadline as a result of a 2019 data breach, and those payments are going out now through November 27, 2023.

If you don’t receive a payment by November 27, then you will not be receiving one.

Capital One 2019 Data Breach Class-Action Settlement

WGAL 8 News reported that emails started going out late last week (the third week of October 2023) to the victims of the 2019 Capital One data breach. The email states exactly how much each member is getting paid in the class-action settlement.

It can vary by how each victim was affected in terms of financial losses, time lost, and identity defense services used.

One person was paid $707 after receiving a confirmation email of payment from ‘noreply@epiqpay.com’ — which means that they opted-in to the settlement by the deadline.

What Happened in 2019?

The Washington Examiner reported that in 2019, a hacker gained access to the personal information of approximately 98 million Capital One users. Capital One announced in July 2019 that it was the victim of a criminal cyberattack on its systems.

Consumers brought numerous lawsuits against Capital One as a result of this data breach, and the lawsuits were overseen by Judge Anthony J. Trenga of the U.S. District Court for the Eastern District of Virginia

$190 Million Class-Action Settlement Agreed Upon

After a lengthy mediation process, both sides agreed to the settlement amount and the court granted final approval for a $190 million class-action settlement on September 13, 2022, to pay the out-of-pocket losses, lost time, identity defense services, account restoration services, and other expenses approved by the court.

The deadlines to file a claim with the Capital One Class Action Settlement were:

  • Filing a claim for lost time: September 30, 2022
  • Filing a claim for out-of-pocket losses: September 30, 2022
  • Filing a claim for identity defense services: September 30, 2022

If you filed a claim by the deadline, you are a “class member” and you would have received a notice with a Unique ID and PIN required to file a Claim Form.

If you are unsure if you are a class member, you can get confirmation by calling 1–855–604–1811 or emailing the plan administrator at:

If you joined this class action settlement by the deadline, payment will be sent by November 27, 2023, by check or digital payment.

"This is honestly the first time that an Instacart delivery person has left the receipt in the bag and my total was $221 and I paid $298 on Instacart...from Loblaws. Damn." -Sophia Kokolakis

  • User 'Cat Officially Cat' says, "That's the price of convenience."
  • User 'TikTokMadeMeSayThat' gives a free tip, saying, "just order through Loblaws website itself. They use DoorDash to deliver and you don't pay any upcharges." (word 'upcharges' corrected in comment)
  • User 'John C' says, "It clearly tells you on the app whether or not you're going to pay in-store prices or not, depending on what store you choose."
  • User 'Wiara953 says, "I put stuff in my Instacart from Aldi's and went to the store myself and checked the prices. They tax the stuff like crazy."

"As an Instacart shopper, I get sticker shock when I see the price the customer is paying vs. what the store is actually charging."
Jenny (Instacart shopper) said:
"We're supposed to keep the receipt for 30 days per our contract. The price mark up is insane though. Instacart makes money on every item you buy."
Mia (Instacart shopper) said:
"Do you live in the states? In Canada, we have to leave the receipt."
Boopie Jones (former Instacart shopper) said:
"During the brief moment I shopped for them is when I realized they were scamming customers & underpaying shoppers. Def left the receipt in their bag."

Readers, it's time for you to share your thoughts on the subject:

Do you think that customers would tip less or stop using the service if they found out how much Instacart is charging people for convenience?

Question: Why did the turkeys cross the road?

Answer: To get to the other side.

Turkeys crossing the road is what caused a ruckus in Thornton, Colorado. Seen below is a photo of the local "Turkey woman" helping turkeys cross the street.

A Thornton Woman Wants to Help Turkeys Cross a Busy Road

FOX31 KDVR News reported that Mary Ann Strauch was just "helping turkeys cross the road" not far from her residence at York Street and 124th Avenue when a motorist "sped around her," almost hitting her.

During the incident, "Turkey lady" Mary Ann Strauch tapped the back of the car with a stick she used to herd the turkeys, and that set the driver off.

Mary Ann said:

“She got really irate and jumped out and started yelling at me,” Strauch said. “And she insisted on calling 911 and having the police come out, and then we were all detained out here about 2 and a half hours.” -Mary Ann Strauch, the "Turkey lady"

Thornton Police arrived at the scene and sorted out the situation, and ultimately cited both women for disorderly conduct. This upset Mary Ann Strauch because she was just wanting to help nature.

She said:

“I try to help the birds be safe, and I think I’m helping the motorists as well,” she said. “Most of the people seem to really enjoy the birds, and they really appreciate me being out here helping the birds.” -Mary Ann Strauch, the "Turkey lady"

Signs at Turkey Crossings Don't Slow Car Traffic

Karen Bigelow, a Thornton City Councilmember worked with the turkey lady to get turkey crossing signs installed, but signs alone don't slow cars buzzing by, and the city can't do anything to slow the traffic, either.

“What I was told is we can’t touch the turkeys, we can’t re-home them, because they’re wildlife,” she said. “I don’t understand why we can’t rehome these turkeys when we do rehome prairie dogs from development areas. What’s the difference? I’ve not been able to get an answer on this at all.” -Karen Bigelow, Thornton City Councilmember

Turkey lady Mary Ann Strauch says that despite this incident, she will keep helping these turkeys across the road.

Why?

To help them get to the other side safely. Mary is concerned cars will hit them.

She said:

“When they cross these busy roads, particularly 124th or York, they are getting run over,” she said of the turkeys. “I wonder what happens when someone gets in an accident because of the turkeys?” -Mary Ann Strauch, the "Turkey lady"
